Terms and Conditions
When you register on the Ravior website by providing your personal data and information, you consent to us collecting and storing your personal data to process your purchases. All data is collected, processed, used and stored lawfully, in accordance with data protection law, including the Data Protection Act 2017, which aligns with the RGPD (General Data Protection Regulation) Act of 25 May 2018.
Ravior reserves the right to amend this Privacy Policy in accordance with changes to applicable law or regulatory requirements. We therefore recommend that you check this page regularly to be informed of any changes.
DEFINITIONS AND INTERPRETATIONS
In these terms and conditions, unless the context otherwise requires:
The term ‘we’ or ‘us’ refers to Ravior Co. Ltd (‘Ravior’), a company with its registered office at 88 St Jean Road, Quatre Bornes, Mauritius and registered number C22977 with the Registrar of Companies.
‘You’ means the purchaser of the Product from us and also refers to the importer of the Product in the case of an international sale.
‘Contract’ means the contract between us and the purchaser for the sale and purchase of the Products which incorporates these terms and conditions.
‘Import Charges’ means any taxes, levies, imposts, deductions, fees, rates, obligations, borrowings or withholdings levied or imposed by any governmental body of the intended country, including without limitation customs duties and other interest, penalties, charges, fees or other related amounts.
‘Products’ means jewellery and other items purchased or ordered by you from us.
‘Terms’ means these terms and conditions.
‘Territory’ means the Republic of Mauritius.
1. PRICES
1.1. VAT (Value Added Tax) is included in the price of Products on our site, un-less otherwise stated alongside the purchase price of any product. For orders placed by residents of the Territory or to be delivered to the Territory, VAT will be added and payable by you at the appropriate rate at the time of purchase.
1.2. All prices are quoted in US dollars. All sums are payable in US dollars.
1.3. It is important to note that prices may vary from time to time due to fluctua-tions in the price of raw materials. To place an order, please consult the prices on the site.
1.4. Packing and postage/transport costs are specified individually. We will in-form you on request of the packaging and transport costs for special or overseas orders, which will be invoiced separately from the price of the Products.
1.5. The consignee of the shipment is the importer of record of the country of des-tination and is responsible for all Import Charges, taxes, levies, import duties, rates and obligations levied or imposed by the country of destination, including without limitation customs duties and other interest, penalties, charges, fees or other relat-ed amounts.
1.6. All prices are subject to change at any time without notice.
1.7. Despite our best efforts, some items in our catalogue may be incorrectly priced. If the precise price of an item exceeds the price shown, we will contact you to provide instructions prior to despatch, or we will cancel your order and inform you accordingly.
2. ORDER CONFIRMATION AND AVAILABILITY
3. ORDERING PRODUCTS ONLINE
3.1. It is important that you make sure that all information you provide when or-dering Products online is accurate and complete in all respects at the time of order-ing, and that this information relates to you or the person placing the order, as well as to any third party.
3.2. You must ensure that the product ordered can be legally imported into the country of destination. When ordering on www.ravior.com, the recipient is the importer of record and must comply with all laws and regulations of the country of destination.
3.3. When an order is placed online, the message ‘the order confirmation issued by the company clearing the credit/debit card payment’ does not constitute ac-ceptance of your order by us. We reserve the right to check any discrepancies and an order will only be confirmed if it is verified by us.
3.4. Any error in any order process for technical or other reasons beyond our control authorises us not to process the order, which may be binding on us.
3.5. We may refuse your order and refund any payment made by you at any time before we confirm and accept your order.
3.6. All bank and other charges will at all times be at your expense.
4. CONFIDENTIALITY
4.1. When you place an order, you will be asked to provide us with personal in-formation. We are obliged not to disclose this information, or information relating to your order, to third parties without your consent.
4.2. Except for the purposes of processing the order and arranging delivery, including but not limited to government agencies in order for the Products to be cleared through customs or delivered. By completing the order form, you consent to the use of the information provided to us. Please note that we are also required by local law to keep a record of all our business transactions for a certain period of time. In the case of gifts or other purchases made on behalf of another recipient, you also agree to grant the authorisations set out below on behalf of the recipient named in your order.
4.3. We undertake to process your personal data and information in accordance with the legal and regulatory provisions in force in Mauritius. For more information on how we handle your personal information, please see our Privacy Policy.
5. PAYMENT
5.1. We will only accept orders from persons who are of legal age and capacity under applicable law and who possess a valid credit or debit card issued by a bank accepted by us.
5.2. All payments for the Products and for packaging and delivery charges must be made before the Products are dispatched.
5.3. We may, in certain circumstances, retain an amount equal to an estimated Import Charge (the ‘Import Charge Deposit’) to be deducted from the items in your order for shipment to countries outside the Territory. By placing an order, you au-thorise us to collect the Import Charge Deposit for the applicable items in your or-der. We may charge your credit card to collect the deposit, or request that it be in-cluded in your payment instructions. This deposit will be used on your behalf to re-imburse the designated carriers for the Import Charges they have paid on your be-half to the appropriate authorities or government agencies in the destination coun-try. If the Import Charges Deposit exceeds the actual Import Charges, we will refund you the difference. For details of the actual Import Charges or to obtain documents or receipts relating to customs clearance, you may contact the carrier specified in the shipment confirmation email.
5.4. Online payment is by credit or debit card. We may, at our discretion, accept payment by electronic/telegraphic bank transfer or any other means. In all cases, delivery will not take place until we are satisfied that payment has been made.
5.5. Please ensure that the purchase invoice number appears clearly with all in-structions for payment by electronic/telegraphic bank transfer.
5.6. You have the option of paying for your purchase in 4 instalments. This meth-od of payment is free of charge. The initial payment is made as soon as you confirm your order. This first payment gives you the opportunity to reserve the jewellery. Once the final payment has been made, the jewellery will be delivered.
6. CARRIERS
The carrier’s guarantees are as follows:

7. DELIVERY
7.1. We can give you an estimated, but not guaranteed, delivery date for the Products and will use our best endeavours to deliver the Products within the time-scales given. We are not responsible for delays caused by carriers.
7.2. We will arrange for packaging and decide on the method of delivery, wheth-er by post or otherwise.
7.3. You authorise us to appoint a carrier (or several carriers if necessary) to act as your representative in relation to the relevant shipment, as well as the customs and tax authorities of the countries through which the Products are to transit and the country of destination to clear your product through customs and to process and remit your actual import charges for that item.
7.4. Where several Products are ordered at the same time, we will combine de-livery in a single postal consignment, unless you request that they be delivered separately, thereby incurring additional delivery charges.
7.5. You are responsible for providing an accurate and complete delivery ad-dress. If the parcel is returned to us due to an incorrect or incomplete address, you will be responsible for the cost of re-shipment.
8. CANCELLATION
8.1 You may cancel an order within 2 days of the date on which you placed your order, but in no event after the Products have been despatched. Cancellation must be confirmed to us in writing.
8.2. We will refund the purchase price within 30 days of notice of cancellation, but we reserve the right to charge a restocking fee and any other costs we incur in connection with your order or cancellation.
8.3. In the case of Products manufactured and supplied to your specification or which have been customised for you, you will not have the right to cancel the Con-tract.

10. RISK AND OWNERSHIP
10.1 These Terms are in addition to the traditional terms of use of the Ravior site. Title and risk of loss in the goods pass to the consignee on delivery to the carrier in the Territory. The risk of loss or damage to the goods passes to you at the time of despatch. You must ensure that appropriate arrangements have been made with the carrier to ensure that the Goods are delivered in accordance with your instruc-tions.
10.2. We retain ownership of all Products until all sums due to us have been paid in full.
10.3. You do not have the right to resell any Products until we have received pay-ment in full.
11. GUARANTEES AND LIABILITY
Please note that when ordering online, items displayed on screen may look different to the actual items in shop. Gold, other precious metals and minerals and gemstones will be as described in writing, within acceptable tolerances set by the laws and practices of the Territory.
11.1. We accept no responsibility for damage to the Products after they have been handed over to the carrier. If you require the Products to be certified by an inde-pendent third party, we may arrange for this to be done, but at your expense. In the event of such certification, the costs of the exercise will also be charged to your credit card or must be included in the payment order.
11.2. In the event of a defect in the Products within 6 months of delivery, you must notify us as soon as you become aware of the defect, giving us full details. We will then decide, in consultation with you, whether the defect is our responsibility. If so, we may repair the Products or replace them with similar Products. Any defective Products must be returned to us at your expense.
11.3. We accept no responsibility for wear and tear, accidental damage or failure by you or any third party to comply with any written recommendations provided in connection with the Products.
11.4. Your liability for loss or damage shall in no circumstances exceed the total amount paid by you to us for the Products.
12. NOTICE
12.1. If you wish to give us notice in relation to any matter covered by these Terms, whether or not you call us, you must confirm that notice in writing. Please write to us at the following address, return receipt requested:

12.2. In the case of notices by e-mail, these must be sent to josh@www.ravior.com and you must send them in order to return an acknowledgement of receipt.
13. CUSTOMER NEGLIGENCE
13.1. If you:
● provide us with incorrect personal information, or
● fail to make a payment when it is due, or
● cancel any payment, or
● become insolvent, pending payment of all amounts due to us, or
● commit any breach of these Terms,
we shall, in each such case, be entitled to terminate the Contract and recover any Products supplied for which payment has not been received in full.
13.2. Please note that special requirements may apply to the cleaning, mainte-nance and care of Products made of precious or semi-precious metals, minerals or stones. Please refer to our website for further details. If in doubt, please contact us and we will advise you accordingly. The use of, or contact with, inappropriate chemical Products, or the use of inappropriate cleaning or care methods may dam-age your jewellery.
14. FORCE MAJEURE
14.1. We shall have no liability to you if we are prevented from, or unable to per-form our obligations due to circumstances beyond our control, which include, but are not limited to, extreme weather conditions, force majeure, terrorism, war, strike or difficulties in obtaining materials and/or labour. In all such cases, we reserve the right to terminate the Contract.
15. GENERAL
15.1 If any provision of these Terms is held by a court to be invalid or unenforcea-ble, in whole or in part, this shall not affect the validity or enforceability of the re-maining provisions of these Terms excised from the offending provision.
15.2. Entire Agreement: These Terms govern our relationship with you. The ser-vices offered by Ravior are subject to the general terms and all other terms, condi-tions, policies and notices set forth in the specific agreements between you and Ravior. Accordingly, these Terms should be read in conjunction with any terms, conditions or disclaimers set forth on the pages of this Site.
15.3. Assignment: We reserve the right to assign any rights and obligations we have entered into with you to a third party, on the basis that the existing contractual terms will become the responsibility of that third party. You will not assign your rights without our prior written consent.
16. INTELLECTUAL PROPERTY
16.1. All content on our site, including templates, Products created and Products supplied by Ravior, remain the intellectual property of Ravior, unless expressly agreed otherwise in advance. You do not have the right to make copies or adapta-tions of such Products or models.
17. COPYRIGHT
17.1. All designs and creations originating from Ravior, including works of art, symbols, trade names, are protected by the copyright laws of Mauritius. Any repro-duction or copying is illegal. Any dispute shall be subject to the jurisdiction of the courts of Mauritius in accordance with paragraph 18 below.
18. INDEMNITY
18.1. You agree to indemnify and hold us harmless from and against any claim, action, suit or proceeding brought or threatened against us arising out of (a) your use of the services offered on our site, (b) the use of such services by any other par-ty using your user ID, verification PIN and/or any identification number, and/or (c) any breach by you of any of these Terms.
19. APPLICABLE LAW AND DISPUTES
19.1. These Terms, including any contract or agreement between us, shall be governed by, construed and enforced in accordance with the laws of the Republic of Mauritius.
19.2. Any dispute between us shall be finally and exclusively determined by the courts of the Republic of Mauritius and you agree to submit to the jurisdiction of those courts.
